Welcome to Lychee Press. This website, www.lycheepress.com (the "Site"), is operated by Lychee Press LLC, a California limited liability company ("Lychee Press," "we," "us," or "our"). Lychee Press was formerly known as Mina Learns Chinese.

These Terms of Service ("Terms") govern your use of the Site and any purchase you make through it, including books, personalized items, gift add-ons, digital resources, and coaching services (together, the "Services"). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund Policy, which are part of these Terms. If you do not agree, please do not use the Site.

1. Who may use the Site

You must be at least 18 years old, or the age of majority where you live, to place an order or create an account. Our books are made for children, but the Site is meant for parents, caregivers, educators, and other adults. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us at info@lycheepress.com and we will delete it.

2. Your account and information

You agree to give us accurate, current, and complete information when you place an order or create an account, and to keep it updated. You are responsible for keeping your login details private and for all activity under your account. Tell us right away if you suspect unauthorized use.

3. Products, pricing, and availability

We try to describe our products and show their colors accurately, but screens vary and we cannot guarantee that what you see on your device matches the printed book exactly.

Prices are in US dollars and may change without notice. Sales tax is added at checkout where required. Quantities may be limited. We may correct pricing or description errors, cancel orders affected by an error (including after you have placed the order), and limit or refuse any order, including orders that appear to be placed by resellers. If we cancel or change your order, we will contact you using the details you gave at checkout and refund any amount you paid for cancelled items.

4. Orders, payment, and shipping

An order is accepted when we ship it or, for digital items and coaching, when we send your confirmation. Payment is due at checkout through the payment methods offered on the Site. Shipping options, costs, delivery estimates, and international duties are described in our Shipping Policy. Risk of loss passes to you when we hand the package to the carrier. Please check your shipping address carefully; we are not responsible for packages sent to an address you entered incorrectly.

5. Returns and refunds

Our Refund Policy explains what can be returned, within what time, and how. In short, unopened books in resalable condition may be returned within the window stated in the Refund Policy. Personalized or signed items, gift wrapping, handwritten cards, digital downloads, and completed coaching sessions cannot be returned or refunded except where the item arrived damaged or we made an error. If your order arrives damaged or incorrect, email us within 7 days of delivery with photos and we will make it right.

6. Personalized items and gift options

Some products can be personalized with a name, message, or signature, and some orders can include gift wrapping or a handwritten card. You are responsible for the spelling and content of any text you submit. We produce it as written. We may decline any personalization or gift message we consider offensive, infringing, or otherwise inappropriate, and will refund that item if we do. Personalized items and gift add-ons are made to order and are final sale.

7. Digital downloads and free resources

Downloads, printables, lesson plans, audio readings, and similar resources are licensed, not sold. We grant you a limited, non-transferable license to use them for personal, family, or single-classroom, non-commercial purposes. You may not sell, share, post online, or redistribute them, or remove any copyright notice. Educators may print copies for their own students. Digital purchases are delivered by email or download link and are non-refundable once delivered.

8. Coaching services

We offer self-publishing coaching sessions, sold individually or in packages. The following applies to those sessions:

  • Scheduling. After purchase, we will contact you to schedule. Sessions are held by video chat. Please give at least 24 hours' notice to reschedule. Missed sessions without notice may be forfeited.
  • Packages. Sessions in a package must be used within 12 months of purchase unless we agree otherwise in writing.
  • Refunds. Unused sessions are refundable within 14 days of purchase. Completed sessions are not refundable.
  • What coaching is. Coaching is educational guidance based on our own publishing experience. It is not legal, tax, financial, or professional advice, and we do not guarantee sales, rankings, awards, or any other result. Decisions about your book and business are yours.
  • Your work. You keep all rights to your manuscripts, illustrations, and other materials. We will not share them outside Lychee Press without your permission. You may not record sessions without our consent.

9. Printing quote requests

If you request a children's book printing quote through the Site, we will pass your project details to the offset printer we work with and share their quote with you. Unless we state otherwise in writing, any print order you place is a contract between you and the printer, on the printer's terms, and Lychee Press is not responsible for the printer's pricing, quality, schedule, or performance. Submitting a quote request adds you to our email list; you can unsubscribe at any time.

10. Wholesale

Retailers, schools, and libraries may buy at wholesale through Faire or under a separate written agreement with us. Wholesale orders are governed by those terms, not by the consumer terms in Sections 3 through 6. Products bought at wholesale may not be resold on Amazon or other online marketplaces without our written permission.

11. Our intellectual property

Everything on the Site and in our products, including books, text, illustrations, characters (such as Mina), audio recordings, photos, videos, designs, logos, and the names Lychee Press and Mina Learns Chinese, belongs to Lychee Press or our licensors and is protected by copyright, trademark, and other laws.

You may view and print pages from the Site for your personal, non-commercial use. You may not copy, scan, reproduce, translate, adapt, publish, distribute, sell, or create derivative works from our books or other content, or use any of it to train artificial intelligence or machine learning models, without our written permission. Buying a book gives you the physical copy, not the right to reproduce its contents.

Reading our books aloud to children in your home, classroom, library, or storytime is always welcome. If you want to record and share a read-aloud, translate a title, or license our work in any other way, email info@lycheepress.com.

12. Reviews, photos, and other submissions

We love hearing from you. If you post a review, send a photo, tag us on social media, or otherwise submit content or ideas to us ("Submissions"), you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, edit, publish, and display that content in any medium, including on the Site, in our marketing, and on social media, with or without your name. You confirm that you own the content or have permission to share it, that it does not violate anyone's rights, and that any child shown is your own child or one whose parent or guardian has agreed. We may remove Submissions for any reason and have no obligation to keep them confidential, compensate you, or respond.

13. Marketing communications

If you sign up for our emails or texts, or agree to join our list when submitting a form, we will send you marketing messages. You can unsubscribe at any time using the link in any email or by replying STOP to a text. Order and service messages will still be sent. See our Privacy Policy for how we handle your information.

14. Prohibited uses

You may not use the Site or Services to:

  • break any law or infringe anyone's rights, including intellectual property rights;
  • submit false information or impersonate another person;
  • harass, threaten, or discriminate against anyone;
  • upload viruses or malicious code, or interfere with the Site's security or operation;
  • scrape, crawl, or copy Site content, product data, or customer information by automated means;
  • send spam or phishing messages; or
  • resell our products or Services without permission.

We may suspend or terminate your access, cancel orders, and refuse future service if you violate these Terms.

15. Third-party links and tools

The Site links to and uses third-party services such as Amazon, Faire, Bookshop.org, payment processors, and social media platforms. We do not control those services and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms.

16. Disclaimer of warranties

Except as expressly stated in these Terms or required by law, the Site, its content, and the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or secure, or that information on it is always accurate or current. Nothing in this section limits the warranty rights consumers have under California law.

17. Limitation of liability

To the fullest extent permitted by law, Lychee Press and its members, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site, the Services, or any product, even if we were advised of the possibility. Our total liability for any claim arising from these Terms or any purchase will not exceed the amount you paid us for the product or service at issue in the 12 months before the claim, or $100 if you paid nothing. Some jurisdictions do not allow these limits, so they may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless Lychee Press LLC and its members, employees, contractors, and agents from any claim, loss, or expense, including reasonable attorneys' fees, arising from your breach of these Terms, your Submissions, or your violation of any law or third-party right.

19. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. If you have a problem, please email us first at info@lycheepress.com; most issues can be resolved in a few messages. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction, except that either party may bring an eligible claim in small claims court.

20. Changes to these Terms

We may update these Terms from time to time. The current version, with its effective date, will always be posted on this page. Changes apply to orders placed after they are posted; your continued use of the Site after that date means you accept the updated Terms.

21. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies referenced in them, are the entire agreement between you and us about the Site and Services and replace any earlier terms, including those posted under the Mina Learns Chinese name. You may not assign these Terms; we may assign them in connection with a sale or reorganization of our business. Sections 7, 11, 12, and 16 through 21 survive termination.
